Con la Camera di Consiglio del 17 gennaio u.s. il TAR del Lazio ha costretto l'Amministrazione Difesa a depositare una relazione che tenesse conto dell'evoluzione normativa dei Marescialli dell'EI e che quindi fosse una risposta all'istanza/diffida presentata in data 1/12/2022 per la quale l'AD non si era espressa, rinviando la discussione del ricorso al successivo 28 febbraio u.s..
L'AD per l'occasione ha depositato la relazione chiesta dal Tribunale esprimendo che gli interventi giuridici ed economici chiesti dai Marescialli necessitano di interventi legislativi e che la parte impiego del personale e saturazione organici è demandata alla Forza Armata di appartenenza.
Il Tribunale Amministrativo ha confermato che la soddisfazione dell’interesse dei ricorrenti non può realizzarsi attraverso provvedimenti amministrativi del Ministero, interventi di riforma legislativa o, comunque, spettanti a diversa competenza istituzionale.
La somma sarà destinata a perseguire gli obiettivi condivisi tramite il mutuo soccorso volontario riguardante le tematiche dei Marescialli Nuovo iter.

In the Council Chamber of 17 January, the Regional Administrative Court of Lazio forced the Defence Administration to file a report that took into account the evolution of the regulations of the marshals of the Italian Army and that was therefore an answer to the petition/request presented on 1/12/2022, on which the AD had not expressed an opinion, postponing the discussion of the appeal to 28 February.
On this occasion, the AD filed the report requested by the Court, expressing that the legal and economic interventions requested by the marshals require legislative interventions, and that the employment of personnel and saturation of staff is left to the Armed Force to which they belong.
The Administrative Court confirmed that the satisfaction of the plaintiffs' interest cannot be achieved through the Ministry's administrative measures, legislative reform measures or, in any case, interventions pertaining to a different institutional competence.
The sum will be allocated to pursue the shared objectives through the voluntary mutual aid concerning the issues of the marshals new iter.
